My name is Thomas Mulvihill. I practiced law in the State of California as a litigation attorney for thirty three years. I now serve as an arbitrator with the American Arbitration Association ("AAA"), the Financial Industry Regulatory Association ("FINRA") and by private appointment.
I was employed as a partner with Lewis Brisbois in San Francisco, CA; with Boornazian Jensen and Garthe in Oakland, CA; and with Low, Ball and Lynch in San Francisco, CA. I held multiple legal management positions during my career, including managing partner, board member and board chairman. Prior to attending law school, I was employed as a securities broker with Paine Webber in San Francisco, CA.
I am a graduate of the University of California, Berkeley and the University of San Francisco. I am a licensed member of the State Bar of California and I have previously held multiple securities licenses with the National Association of Securities Dealers.
I represented international and domestic insurers as coverage and litigation counsel. I have extensive analytical experience with Commercial General Liability Policies, Commercial Excess Policies, Commercial Umbrella Policies, Errors and Omission Policies, Commercial Property Policies, Commercial Auto Policies, Business Interruption Policies and Personal Lines Policies, I have extensive litigation experience involving claims of breach of contract, breach of the implied covenant, duty to defend, duty to indemnify, right to independent counsel, equitable contribution, equitable indemnity, equitable reimbursement, waiver and estoppel, subrogation, reformation, recission, cooperation clause, supplementary payments, voluntary payments and remedies.
I represented developers, contractors, subcontractors and design professionals as litigation counsel. I have extensive analytical and litigation experience involving claims of breach of construction contract, breach of express warranty, breach of implied warranty, negligence, strict liability, fraud, misrepresentation, statutory violations, licensure, express indemnity, implied indemnity, risk transfer, mitigation, statute of limitations, waiver and estoppel, disgorgement, specific performance, remedies, pre-judgment interest, costs and attorney fees.
I represented broker dealers, registered representatives and private investors as litigation counsel. I have analytical and litigation experience involving claims of breach of contract, professional malpractice, excessive trading, unauthorized trading, suitability, manipulative conduct, breach of fiduciary duty, negligence, fraud, misrepresentation, statutory violation, unjust enrichment, elder financial abuse, remedies, punitive damages, pre-judgment interest, costs and attorney fees.
I appeared as counsel in multiple appellate matters in the Ninth Circuit Court of Appeals, the California Supreme Court and the California Court of Appeal. I was a frequent public presenter on litigation and substantive law topics. A list of appellate matters and public presentations is available upon request.
I am a Fellow of the American College of Coverage Counsel (“ACCC”). I volunteer weekly as a pro bono counsel at a local legal clinic; I serve as a writing coach at a local public high school; and I am an appointed member of the Peralta Community College Parcel Tax Oversight Committee.
I am a Panel arbitrator with the AAA for both Construction and Consumer disputes. I also serve as a chair-qualified industry arbitrator for FINRA. I also entertain private appointments to serve as an arbitrator for insurance coverage disputes.
